Affordable Housing and Community Development Law
Ellinger & Carr provides counsel in matters relating to affordable housing, subsidized housing, community development, tax credits, bond financing and municipal law matters. Firm lawyers in this practice have developed unique experience, each complementing the other’s key strengths.
Susan Ellinger represents clients in matters involving nonprofit entities, partnerships, limited liability companies, and housing authorities throughout North Carolina and South Carolina and elsewhere on the East Coast, from New York to Florida, and in the Gulf Coast in public-private practice alliances as part of the recovery from the devastation of Hurricanes Katrina and Rita. Firm engagements include all types of contract negotiation matters, commercial real estate development, and complex leases, negotiations with local, state, and federal agencies, including North Carolina and South Carolina housing finance agencies, cities and counties, the Department of Housing and Urban Development, and the Internal Revenue Service.
The firm also has extensive experience in Home loan regulation, Federal Home Loan Bank financing, municipal bond financing of affordable housing, community development block grants, legislation, procurement, HOPE VI, and other state and federal financing sources of affordable housing and community development.
Business Law
The firm’s lawyers have more than 40 combined years of representation of both small and large companies, from start-up to mergers and acquisitions.
Steven Carr’s longtime experience with investor-owned public utility companies, utility holding companies and nonutility subsidiaries has provided him with broad experience and a sophisticated understanding of commercial structures, project and bond financing, corporate and securities matters, government contracts, corporate governance, corporate compliance, business litigation, and dispute resolution of both internal and external conflicts in the corporate setting, including nonprofit and tax exempt organizations. Mr. Carr’s clients include Progress Energy, a Fortune 250 investor-owned utility holding company operating in the Carolinas and Florida.
Similarly, Ms. Ellinger has assisted small businesses, nonprofits, and housing authorities in their business relationships and management, including establishment of subsidiaries and nonprofits, general board advisement, review of corporate structures and corporate compliance.
Banking and Finance
Ms. Ellinger and Mr. Carr have represented and continue in their practice to represent banks, thrift institutions, and credit unions in complex, multi-million dollar matters and asset-based secured transactions.
These representations include loans, equity, leasing structures, mezzanine financing, commercial real estate developments and workouts, and also include representations of borrowers, equity investors, shareholders and developers.
Ms. Ellinger and Mr. Carr are both listed in the Red Book of the Bond Buyer’s Municipal Marketplace.
In addition, Ms. Ellinger has represented the City of Raleigh in its community development lending program for many years.
